AbstractThe purpose of this study was to compare the Title IX guidance from the U.S. Department of Education Office for Civil Rights from the 2011 "Dear Colleague" letter and the 2020 "Final Rule," and then to interview university Title IX coordinators about their experiences responding to the substantial changes under each administration's policies. In this study, I addressed the fluctuations in Title IX guidance, and how Title IX offices in institutions of higher education can maintain compliance amid such impermanence. Research questions included: How did the U.S. Department of Education Office for Civil Rights' Title IX guidance from the 2011 "Dear Colleague" letter compare to the 2020 Title IX "Final Rule?" How did these contrasting reforms affect University Title IX offices and their policies? How did such fluctuations impact coordinators in these roles? This study was an examination of the relationship between Title IX guidance published by the U.S. Department of Education's Office for Civil Rights and the pursuant actions taken by the Title IX Coordinators at America's colleges and universities. Additionally, this study addressed Title IX Coordinators' reflections and actions regarding the 2011 and 2020 "Dear Colleague" letters through qualitative interviews. This was a qualitative study--data was collected through document analyses and phenomenological study. For the phenomenological portion of this study, I used purposeful and snowball sampling, yielding four participants. Data were analyzed and coded, and common themes were developed. Key differences between analyzed documents included mediation as a feasible avenue to resolution, and the evidentiary standard required to determine responsibility for misconduct. Changes in Title IX law resulted in establishment of specialized Title IX offices, and associated staff has increased with time. Title IX laws and guidance will continue to change, and it will be necessary to maintain a student-centered perspective as institutions adapt to ever-changing Title IX laws.
