AbstractThe ethical treatment of human participants in medical research has been a focus of discussion for centuries. Less talked about, unfortunately, is how participants of social science research, especially of the kind of research found in educational settings, are protected from unethical procedures or investigators. Title 45 of the U.S. Code of Federal Regulations, Part 46, contains provisions generally allowing educational research to be exempt from Institutional Review Board review process. Recent legislative movements, together with rapidly changing technologies and research approaches, are forcing a reconsideration of this traditional exemption. This paper summarizes the federal regulations under which educational researchers are expected to operate. Recent legislative imperatives are reviewed, and the role of the Institutional Review Board is discussed. New questions concerning the ethical treatment of human subjects in educational research are raised. and suggestions for how each institution might address these challenges to the research process are presented. Attachments include "The Belmont Report," a report on ethical principles for the protection of human subjects from the National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research, Title 45 of the Code of Federal Regulations, and selected portions of federal acts and commentary.
