| Abstract | This background paper reviews copyright, patent, and trade secret protections as these issues are related to computer software. Topics discussed include current issues regarding legal protection for computer software including the necessity for defining intellectual property, determining what should or should not be protected, commerical piracy, and shared access to state-of-the-art knowledge and diffusion of information so that programmers can build on each others' work. Questions for Congressional consideration focus on definition and distinction of computer software terminology, the structure of the software industry, the nature of innovation, and the protection and enforcement of software.
