AbstractThis guide for school district administrators presents workshop materials for administrators' mutual training. The guide assists administrators in preventing lawsuits by teachers against the district for violations of the First Amendment right to freedom of speech. Section 1, the introduction, offers two objectives: to acquaint administrators with teachers' legal limits on the First Amendment right to speak freely on matters of public concern and to discuss school boards' legal rights to limit teachers' classroom autonomy, or "academic freedom." Section 2, "Preliminary Considerations," gives examples of U.S. Supreme Court rulings defining speech that is protected and that which is not. "Teachers' Rights to Speak as Citizens," section 3, analyzes repercussions of the "balancing test" used by the court to establish rights public employees may be allowed under the First Amendment. Section 4, "Academic Freedom," notes that, although teachers do not possess a clearly defined constitutional right to academic freedom, lower courts often support the right. The Supreme Court's position is put into perspective by examples and hypothetical case exercises. Section 5, the conclusion, pursues finer points of applying the academic freedom standard.
