| Abstract | This handbook is designed for use by board members, administrators, and teachers to aid them in understanding the legal aspects of governance, management, and operation of public schools in West Virginia. Substantial discussion is devoted to sources of school law (common law, state and federal constitutions, state and federal statutes); the legal framework of West Virginia's public schools; student, teacher, and administrator rights and responsibilities; and financing public education in West Virginia. There are brief discussions of legal aspects of collective bargaining and accountability in West Virginia. Significant state and federal court decisions related to public education outside West Virginia are included, as are interpretations of state statutes pertaining to education by the state superintendent of public instruction and the state attorney-general.
