AbstractA dual welfare system exists in Germany. Non-statutory welfare is represented by six central associations. Islamic welfare organisations have also emerged in recent years. For example, An-Nusrat e.V., a non-profit Islamic welfare association with additional regional associations, was established in 2018. In the area of marriage, family and childhood, Muslims in Germany face numerous challenges related to legal, religious and ethical factors, which can lead to conflicts. This is due in part to different everyday practices and to Islamic traditions, which play an important role in family relationships. For many Muslims, the being together of man and woman is only imaginable in marriage. In this respect, common law marriages without registration and proxy marriages are considered valid, even if they are not effective under German law. Dowry agreements or parental rights and duties can only be based on the German legal system, even if other interpretations exist. In international private law, the link to habitual residence is established through international treaties in Germany, too. Consequently, problem areas arise that cannot be solved without outside help, especially for women and children (for example: exclusion, violence, restrictions on residence rights). Independent Islamic welfare can perform important work in this area by supplementing and expanding the services offered by the state through counselling, psychological and religious support, legal assistance, material support, etc.
