AbstractThis article presents a case study that engages students on the legal and ethical issues of doing business abroad. It explores the scenario of direct foreign investment by an American company in a less developed country. This development imbalance necessarily implicates issues of ethical relativism and home-host country standards. Students are given a fact scenario and are asked to play the role of a manager who must decide whether to maintain the company's presence in the foreign country (Malaysia). The students are given five options to consider and present to the board of directors. The five options raise issues relating to corruption and the Foreign Corrupt Practices Act, theory of relative development, business and ethical calculations, environmental ethics, sustainability, and the choice between short-termism and long-term strategic decision making. The educational objectives of the case study include: (1) examining the fusion of good business with good business ethics; (2) using the law strategically, to advance the application of ethical decision making that broadens the benefit-cost analysis at the time of the decision and that takes a longer-term perspective of the consequences of a decision; and (3) simulating real-world decision making in order to enhance skill sets relating to stakeholder analysis and ethical decision making.
