(DIPF/Orig.). The formulation of a fundamental right to "school education" by the Federal Constitutional Court, namely as a "guarantee obligation" of the state for an "indispensable minimum standard of school education", is appreciated in the article as a serious caesura in the case law of the court and most commentators, which has so far tended to ward off a fundamental right to education. At the same time, the new fundamental right is placed in the constant and broad discussion since the 19th century about the "fundamental right to education" as the right to a "compulsory minimum education". From the status of law as a "derivative", "subjective performance law", the follow-up questions and handling options for educational policy, jurisprudence and educational research are finally discussed."
