Abstract | This state plan for education of students with disabilities in New York provides information on how the state's provision of special education programs and services in the least restrictive environment complies with federal law and regulation (especially the Individuals with Disabilities Education Act). The report describes planning and program initiatives to be undertaken at the state level during 1993 to 1995. The plan is organized according to the federal checklist provided by the Office of Special Education and Rehabilitative Services. Each section describes how New York State meets the federal requirements specified in the corresponding section of the checklist. The plan covers: assurances, statement of affirmation, right to education policy statement, full educational opportunity goal, child identification, individualized education programs, procedural safeguards, confidentiality of personally identifiable information, least restrictive environment, protection in evaluation procedures, responsibility of the state educational agency, State Comprehensive System of Personnel Development, private schools, recovery of funds, notice and opportunity for hearing on local education agency application, annual evaluation, description of use of Part B (of the Individuals with Disabilities Education Act) funds, additional information, interagency agreements, and personnel standards.
