| Abstract | In September 2008, while the national spotlight was on the economic crisis, the Iraq war, and the presidential election, Congress passed by acclamation, and President Bush signed without fanfare, the Americans with Disabilities Act Amendments (ADAA). Effective Jan. 1, 2009, the ADAA not only significantly reversed major judicial interpretations of "individual with disability" under the ADA, but also applied the central part of these new standards to Section 504 of the Rehabilitation Act of 1973. Although the AADA's primary focus was on employment, with special emphasis on returning Iraq veterans, the amendments dramatically expanded eligibility of K-12 students under Section 504. The nature and extent of this expansion are demonstrated by the case presented in this article and the accompanying question-and-answer discussion, which represent a marked departure from the case law during the past decade, including some major Supreme Court decisions.
