AbstractPrepared by the District of Columbia Street Law Project for its annual city-wide mock trial competition, this instructional handout provides material for the hearing of a custody dispute. Martha Winstead petitions the court to order the Church of the New Family to turn over her 18-year-old son, Jeremiah, to her and to allow her custody. Jeremiah dropped out of college to move into the Church headquarters and to collect money for the Church at subway stations. The handout clarifies the laws and explains the legal precedents. As evidence, the handout provides Jeremiah's affidavit asserting that the Church had brainwashed him; a letter he sent to his mother requesting money; a synopsis of key principles of the Church; and witness statements from an expert in exploitative cults, a follower who left the Church, Martha Winstead, the Church leader, and Jeremiah. Through participation in mock trials and analysis of the activity, students gain an insider's perspective on courtroom procedure and a basic understanding of the legal mechanism through which society resolves its disputes. Mock trials develop critical analysis, questioning and listening skills, and skills in preparing and organizing materials. (JD)
