AbstractThis document analyzes the highlights of school finance litigation, including early attempts at convincing the U.S. Supreme Court to declare education as a fundamental right guaranteed by the U.S. constitution, and recent arguments that have shifted the responsibility for delivering education entirely to the states. Cases described include: (1) "Serrano v. Priest"; (2) "San Antonio Independent School District v. Rodriguez; (3) "Robinson v. Cahill"; (4) "Lujan v. Colorado State Board of Education"; (5) "Pauley v. Kelly"; (6) "Britt v. North Carolina"; (7) "Abbot v. Burke"; (8) "Kukor v. Grover"; (9) "Dupree v. Alma School District No. 30"; (10) "Edgewood Independent School District v. Kirby"; (11) "Helena Elementary School and (12) "Rose v. Council for Better Education." Traditional applications of state constitution equal protection provisions and decisions made regarding funding disparities are explored. Appended are a list of significant litigation that challenged state education finance systems and a National School Boards Association (NSBA) Council of School Attorneys Audio Tape Library Order Form, Publications Order Form, and membership information request form.
