AbstractAs school communities become more diverse, making decisions regarding discipline will continue to be difficult. However, providing appropriate discipline for special education students is essential in order to maintain an effective learning climate. This article walks readers through a hypothetical situation in which a principal must make a decision about how to discipline a student with a learning disability who was involved in a fight. Under the Individuals with Disabilities Education Improvement Act, before suspending this student the school must ensure that an IEP or manifest determination review (MDR) is held to determine the answers to the following questions: (1) Was his involvement in the fight caused by or substantially related to his disability?; (2) Was the conduct in question the direct result of the local educational agency's failure to implement the IEP?; and (3) What placement issues exist that must be considered before the principal makes her discipline recommendations? If an inappropriate action is taken, the district may be open to litigation. To reach legally correct decisions and avoid unnecessary conflict during the discipline phase of school leadership, the savvy school leader must keep his or her professional knowledge of special education law current. To provide further guidance for administrators, some examples of court decisions upholding or overturning district action are discussed. (ERIC).
