AbstractThis paper is part of a collection of 54 papers from the 48th annual conference of the Education Law Association held in November 2002. It addresses education finance litigation generated by "Serrano v. Priest." (Considered a landmark decision of the Supreme Court of California, "Serrano" resulted in victory for funding-equity plaintiffs and established a model for similar litigation in other states.) This paper is a report of a study based on a review of relevant published opinions and scholarly commentary since "Serrano." It discusses the efficacy of funding litigation, the continuing evolution of funding litigation, shifting balances of state and local control, and the potential future of funding litigation. The paper concludes that litigation spawned by "Serrano" continues to thrive and evolve throughout all 50 states and shows no indications of subsiding. Plaintiffs appear to be placing a greater emphasis on tangible evidence of disparities in educational resources and less emphasis on per-pupil expenditures. Judges appear to be focusing more on defining the parameters of a minimally adequate public education under their state's constitution than on mere per-pupil funding disparities.
