General terms and Conditions of the German Education Index

1. Scope of delivery

The German Education Index (FIS Bildung) of the German Institute for International Educational Research (DIPF) provides its users with online access to the German Education Index database - http://www.fachportal-paedagogik.de/fis_bildung/fis_form_e.html.

In general, the German Education Index is available online 24 hours a day, but the German Education Index reserves all rights to limit this services, or temporarily discontinue the database for technical reasons.

The database contains references only (bibliographic descriptions, key words, abstracts), , not the texts as such. As a rule, the user will need to obtain (and if necessary pay for) the texts herself/himself (online texts that are subject to a fee or printed titles) by contacting external document delivery services, the local library or commercial bookstores. As an exception, electronic texts that are available on the internet free of charge are directly accessible by a link.

2. Reservation of rights

The German Education Index reserves its right to modify the database provisions.

3. Disclaimer

The German Education Index assures a high professional standard and the diligence of professional documentation for the bibliographic database, to our best knowledge. Nevertheless, we cannot be held liable for the accuracy of the information we provide, neither is the German Education Index responsible for the contents of external websites that are accessible via hyperlink. Liability claims against the German Education Index are principally void, as long as no deliberate or wantonly negligent faults caused by the German Education Index or its legal representatives can be proven.

4. Costs and terms of payment

Anyone can use the German Education Index free of charge.

5. Copyright legislation/limitations of use

All copyright reservations remain. Retrieval records including electronic full texts are determined for individual use only, and in the case of information brokers, for the individual use of their respective clients. If the user is acting as a member of an organisation/institution, the use of retrieved records and electronic full texts is only permitted for the immediate use by members of this particular organisation/institution (e.g. higher education students at a university). It is not permitted to download the complete database or large parts of it, neither is it permitted to copy and distribute information gained from the German Education Index.

If third party services are acquired by mediation of access to the database, e.g. document delivery services, the terms and conditions of these providers apply. In these cases, business contracts are exclusively made between such third parties (e.g. libraries) and the user. Possible claims resulting from such contracts can only be held against the third party, and not against the German Education Index as such.

Use of the electronic full texts is subject to German copyright legislation (UrhG)

6. Rights and obligations of the user

The users commit themselves to strictly adhere to the conditions of use and dissemination of information gained from the German Education Index outlined in section 5. By using the German Education Index, the user confirms his/her agreement to the terms and conditions.

7. Confidentiality/data protection

The German Education Index is committed to treating all data that are entered in the dialogue with the database confidentially.

8. Place of delivery/jurisdiction

Legislation of the Federal Republic of Germany is applicable here. The place of delivery and jurisdiction is Frankfurt am Main, where the German Institute for International Educational Research (DIPF) is located, which hosts the co-ordinating office of the German Education Index.

9. Salvatorius clause

In case one of the terms and conditions turns out to be inactive or voidable, the other conditions remain unaffected.
